You may wonder to yourself why Cannabis Activists want to make such a huge skunky stink in the media over the facts, incessantly pointing out the corruption that caused  Cannabis to be illegal, and why the arbitrary and socially destructive policies of the past seventy years should be rescinded.

You may even attach a stereotype to these people and dismiss them as lazy, worthless, not in control of their lives, and as such mentally dismiss them as a fringe group. You may think to yourself that the interests of a bunch of stoners has little or nothing to do with you, or anything in your life, but you would be dead wrong.

Activists are are individuals who are willing to stand up as the conscience of the nation.  Since the prohibition suppressed information about Cannabis,  free speech has suffered the indignity of simply being ignored by the administration of Canada,  and in particular the Federal Conservatives.

Their attack on human rights in Canada in favor of corporate control is insidious, and the continued prohibition of Cannabis in spite of three Supreme court wins is simply the most obvious sign of a diseased and corrupt democracy.

In my view, the constitution stands for the nation, but is crafted by the Charter of human rights adopted in 1982. This document allows us to continually mold our national mindset until all are protected from creeping corporate culture.  The Charter of Rights is intended to guide the creation of the Constitution and create the fairest democracy possible, not for government or business, but for the people of Canada.

We want all our Charter rights (especially Section 7), we already own these rights under law (according to 3 supreme court decisions), and we should not have to sue even once more for them.  Of course that doesn’t mean we aren’t going to, and we will keep suing till we get it done.

Aren’t Human rights for all Canadians?

First of all,  I want to congratulate Matthew Mernagh, and loudly applaud the Ontario Supreme Courts and Justice Donald Taliano, who has given Ottawa until July to repair the federal medical marijuana program, or potentially face  effectively legalizing possession and production of cannabis Canada wide.

The case brought forward and won by Matthew has far reaching implications for Cannabis legalization in Canada, and at the very least sets a legal precedent for patients wishing to use herbal or homeopathic medicines in every other Canadian province.

In my own experience as a newly diagnosed cancer patient, the prospect of submitting to drugs with well-known toxic side effects can be more frightening than the disease itself, and I now know that patients that lack any other choices who get forced into years of treatments with drug induced sickness, addiction, or side effects may lose hope, and even succumb to treatment related complications due to a compromised immune system. Clearly the “cure” is worse than the disease, especially in slower moving  cancers that are easily treated using internally ingested Cannabis oils or tinctures.

The Ontario court’s examination of Section 7 of the Canadian Charter of Right has shown that it is not proper to force patients to endure months or years of toxic medications or poisonous radiation treatments before requesting a natural treatment. Furthermore, Sec. 7 states that a Canadian has the right to choose or select any treatment he may want or even refuse any and all treatments,  no matter what others may think of the wisdom of his decision.

These rights are easily paraphrased as  ‘The Freedom to be Stupid’ and is more obvious when its noted that we have the freedom to do other things that are not good for us, such as drinking, smoking tobacco, or eating reach foods. As my father used to say:  “I disagree with you, but I would fight for your right to say so”.  I always thought that this crystallized the notion of democracy in a way that made it easy to understand.

The decision in Canada V Matthew Mernagh has set a constitutional standard and upheld patients rights under Section 7 of the Canadian Charter of Human rights. Well, we want our Section 7 Charter rights upheld in BC too!

I hope you will speak out, and let whatever Premier rises to lead in BC know that rights gained in Ontario should be applied across Canada! Demand that Canadian law be based on evidence, and not the fear that has been imported from the United States.

The Charter GUARANTEES our rights as Canadians, but we have to DEMAND them!!

90 days to Legalization?

Medical marijuana appeal pondered by Ottawa

Ottawa is considering whether to appeal an Ontario court ruling that if left to stand could make the possession of marijuana legal in the province, officials said Wednesday.

“The government of Canada is reviewing the decision and will consider its options,” Leslie Meerburg, spokeswoman for Health Canada, said in an email.

Justice Donald Taliano gave Ottawa until July to fix the federal medical marijuana program or face the prospect of effectively legalizing possession and production of cannabis.

In a ruling released earlier this week, Taliano found the program to be unconstitutional because sick people cannot get access to medical marijuana through appropriate means and must resort to illegal actions such as growing their own supply.

As a result, ill people who should be able to get the drugs are branded as criminals, he said in the decision.

The St. Catharines justice declared the program to be invalid, as well as the laws prohibiting possession and production of cannabis, since they can be used to criminally charge medical users unable to get the drugs through legal avenues.

If left to stand, the decision — which takes effect in 90 days — would make possession and production of marijuana legal in Ontario, said Alan Young, a Toronto lawyer involved in several other challenges to Canada’s cannabis law.

That would encourage judges in other provinces strike down the law in their jurisdictions when confronted with similar cases, he said.

The matter would likely end up before the Supreme Court of Canada, which can rule on federal laws, he said.

“Health Canada has no Plan B,” Young said Wednesday. “So the knee-jerk reaction will be to appeal” and fight vigorously to obtain a stay of judgment that would keep the law in place until the appeal is resolved, he said.

“This case is just exposing the tip of the iceberg in terms of potential litigation against the government of Canada, so they can defend this all they want by appealing, but they’re not going to escape the onslaught,” he added.

“It makes more sense to concede defeat, surrender and come up with something that really helps Canadians.”

The judge’s decision came in a criminal case involving Matthew Mernagh, 37, of St. Catharines, who suffers from fibromyalgia, scoliosis, seizures and depression.

Unable to find a doctor who would support his application for a medical marijuana licence, Mernagh began to grow his own and was eventually charged with producing the drug.

Taliano found that doctors across the country widely ignored Health Canada’s medical marijuana program and refused to sign off on forms that allow sick people to legally obtain cannabis.

Mernagh’s lawyer, Paul Lewin, said he’s confident the decision will be upheld by the Ontario Court of Appeal.

Meanwhile, Mernagh has been granted an exemption that allows him to smoke and grow cannabis.

“I’ve already started sprouting seeds,” he said.

Canada’s medical marijuana program was created in 2000 after the Ontario Court of Appeal upheld a Toronto man’s right to smoke pot to alleviate his epileptic seizures.

In that case, the court gave Ottawa a year to change the law so that sick people could access the drugs they need, or see it struck down altogether.

I’ve had my eyes open on sites like facebook, and I realize that articles need to be posted in all languages to really make a difference in the movement for the legalization of cannabis!

Anyone who has a wordpress site should consider this: I just installed a language translator here on Oh-Cannabis.com, so you may read our posts in any of over 50 languages from Afrikaans to Yiddish! Any articles already on our sites can be instantly translated, you’ll never believe what its like to see your work written in another language.

Its just another tool that we as writers and communicators can use to spread our compassionate message even further, and make a difference in the lives of people a world away.

Look for it in your wordpress site in add-ons, it is called the GTranslate widget. It seems to work great, of course any feedback is welcome.

If you support prohibition

If you support prohibition then you’ve helped trigger the worst crime wave in history, raising gang warfare to a level not seen since the days of alcohol bootlegging..

If you support prohibition you’ve a helped create a black market with massive incentives to hook both adults and children alike.

If you support prohibition you’ve helped to make these dangerous substances available in schools and prisons.

If you support prohibition you’ve helped put previously unknown and contaminated drugs on the streets.

If you support prohibition you’ve helped to escalate Murder, Theft, Muggings and Burglaries.

If you support prohibition you’ve helped to divert scarce law-enforcement resources away from protecting your fellow citizens from the ever escalating violence against their person or property.

If you support prohibition you’re promoting a policy which kills our children, endangers our troops, counteracts our foreign policy and reduces much of the developing world to anarchy.

If you support prohibition then prepare yourself for even more death, corruption, sickness, imprisonment, unemployment, and the complete loss of the rule of law.

Neurotics build castles in the sky, psychotics live in them; the concept of a “Drug-Free Society” is a neurotic fantasy and Prohibition’s ills are a product of this psychotic delusion.

Prohibition is nothing less than a grotesque dystopian nightmare; if you support it you must be either ignorant, stupid, brainwashed, corrupt or criminally insane.

the War on Drugs is a Slaughter

Nixon started the war on drugs in his Special Message to the Congress on Control of Narcotics and Dangerous Drugs on 14 July 1969 (source).   He declared the war on drugs on 17 June 1971. We have been at war ever since in America.

Here’s the Wikipedia link to War. I just want to make a point about wars. Normally, there are usually two heavily armed and philosophically opposed adversaries fighting for domination of a philosophical idea or resource.

In the case of the international D.E.A. genocide known as the War On Drugs, Cannabis is mainly  and specifically targeted by prohibition forces because the profits prom Cannabis property forfeitures are so lucrative and require little manpower or capital investment to execute. (They like being bullies, and they really dig the easy money)

It is suggested now that the D.E.A. has been reselling confiscated cannabis to companies like GW Pharmaceuticals at a huge profit to themselves. So, while the D.E.A. is fighting for domination of a philosophical idea (control of the Drug industry), it likes the incredible sums of money that Cannabis makes, and so seeks to profit from it. (Crack and Meth users have nothing to steal, whereas Cannabis users tend to be more successful) The D.E.A. is clearly a very confused organization deeply involved in corruption and human rights abuse, and clearly in a conflict of interest.

Heavily armed and technically advanced Secret Services Force uses subterfuge and guerrilla warfare tactics to seek out and attack a mainly unarmed non-violent civilian ‘offender’ engaged in the peaceful pursuit of gardening. During such tactical raids, officers employ what is known as a  ‘full force attack’ to subdue their opponents.

Anything can happen in these highly charged moments, and often the ‘amped up’ officers lose control and shoot and kill innocent bystanders or family members and even small animals such as the family pet. They may not even have the house right, and still kill innocents, who have no legal course of action against these agents.

In a normal democratic society, we would only lock up offenders who are violent and we fear will harm others, rather than with whom we disagree on a point of philosophy, and this is what makes a tolerant democracy work- agreeing to disagree peacefully. In a democracy political dissidents are allowed their point of view, and not thrown in prison like some other countries. Gil Kerlikowski lies that the War On Drugs is over, but the carnage continues. The Secret Police still hunt down Cannabis users. It is not paranoia if they are really after you.

I was eleven years old when police directed their pent up bigotry toward hippies and beat-nicks and easy going Cannabis users became the targets for police attention, so I made it my business to get to know them, and that was when I knew the policed had lied, authority had lied. Knowing I had been lied to ended my trust in government, as it does every other young individual today.

Now, an over worked and technologically stressed out population yearns to ease their suffering without risking their lives with hard drugs and alcohol by using Cannabis, and yet the Secret Police’s secret agenda won’t allow them to cease torturing the weary chattels of the multinational corporations. Sound like hyperbole? In the midst of an ugly propaganda war, everything does. I just can’t say it any more clearly, this system is CORRUPT.

Just ask yourself this: Does it seem like you have more rights than before or less? Are the results of the unregulated corporate world wide romp making the world better or worse? Are you happy or not- with the way corruption is forcing our country into becoming a police state supported by an industrial prison complex?

What kind of message do you think our children are getting? How do you like being complicit with the lies that are being told? Do you think your children have noticed that you are a liar too? How do you like lying to your children to support the state propaganda?

When will you make it end?
